This agreement is between you and Furkan Kaya (“we”, “us”), the developer of DustFox. By downloading or using DustFox you accept these terms. If you do not accept them, do not use the app.
Please read section 6 before you delete anything. DustFox removes photos and videos from your library when you tell it to. That is the whole point of the app, and it is not reversible once you empty your Recently Deleted album.
1. Licence
We grant you a personal, non-transferable, non-exclusive licence to use DustFox on Apple-branded devices that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. You may not sell, rent, sublicense, or redistribute the app, and you may not reverse engineer, decompile, or modify it except where that restriction is prohibited by law.
The app is licensed, not sold. We retain all rights not expressly granted here.
2. Free use and DustFox Pro
DustFox is free to download and includes a free allowance: the Screenshots method has no limit, and every other method may be used on a combined total of 30 items over the lifetime of the installation.
DustFox Pro removes those limits. It is a one-time purchase — not a subscription. It does not renew, there is nothing to cancel, and no further charge will ever be made for it. Pro is tied to your Apple Account, works on your other devices signed in with that account, and is available to your Family Sharing group.
We may change the free allowance in future versions. Any such change applies to future versions only and will never revoke Pro from someone who has bought it.
3. Payment and refunds
All purchases are processed by Apple through the App Store. We do not process payments and never see your payment details. Prices are set per country by the App Store and are shown to you in the app before you confirm.
Refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com. We have no ability to issue, approve, or refuse a refund. If you are unhappy with the app, please contact us anyway — we would rather fix the problem.
4. Privacy
DustFox collects no data. See the Privacy Policy, which forms part of these terms.
5. Acceptable use
Use DustFox only on photo libraries you are entitled to manage, and only in ways permitted by applicable law.
6. Deletion, compression and your responsibility for backups
DustFox permanently modifies your photo library at your instruction. You decide what is deleted and what is compressed; the app carries out that instruction.
- Deleted items are moved to the Recently Deleted album in Apple Photos, where they can be recovered for 30 days. After that, or after you empty the album, they are gone.
- Compression re-encodes a video or photo. The result is visually equivalent but is not the original file, and the original is replaced.
- Selection tools such as the duplicate jury and blur detection are automated judgements. They are good, but they are not infallible. Review a selection before you confirm it.
Keep a backup. Before a large cleanup, make sure your library is backed up — iCloud Photos, a Mac, or an external drive. We are not able to recover anything you delete.
7. No warranty
DustFox is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that its automated judgements will match your own.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits any statutory consumer rights you have that cannot be waived.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, photographs, videos, profits or goodwill, arising out of your use of DustFox — even if we have been advised that such loss was possible.
Our total liability to you for all claims relating to DustFox is limited to the amount you actually paid for the app, or 50 US dollars, whichever is greater.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
9. Apple
Apple requires the following to be part of this agreement, and it is:
- Parties. This agreement is between you and us only, not with Apple. We alone are responsible for DustFox and its content.
- Maintenance and support. We are solely responsible for support for DustFox. Apple has no obligation to provide any maintenance or support for it.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed above. If DustFox fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to DustFox.
- Product claims. We, not Apple, are responsible for addressing any claim relating to DustFox, including product liability claims, any claim that it fails to conform to a legal or regulatory requirement, and any claim arising under consumer protection or privacy legislation.
- Intellectual property. If a third party claims that DustFox infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Third party terms. You must comply with any applicable third party terms of agreement when using DustFox.
- Third party beneficiary. Apple and its subsidiaries are third party beneficiaries of this agreement and, upon your acceptance of it, will have the right to enforce it against you as a third party beneficiary.
- Contact. Questions, complaints and claims should be sent to support@dustfox.app.
10. Termination
This licence continues until terminated. It ends automatically if you breach these terms, and you may end it at any time by deleting the app. Sections 6 through 9 survive termination.
11. Changes
We may update these terms when the app changes. The date at the top will change with them. Continuing to use DustFox after an update means you accept the revised terms; if you do not, stop using the app.
12. Governing law
These terms are governed by the laws of the Republic of Türkiye, and the courts of Istanbul have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings there.
